These Terms and Conditions of Use (hereinafter referred to as "Terms of Usage") govern the access and usage of the website, mobile application, services, features, and content provided by HiAstro ("we", "us", "our", or "HiAstro") through our platforms (hereinafter referred to collectively as the "HiAstro"). By accessing or using the HiAstro, you agree to be bound by these Terms. If you do not agree, please refrain from using the HiAstro.

1. UPDATION OF TERMS

1.1 These Terms of Usage may be updated or modified from time to time without prior notice. The latest version will be available on the HiAstro. Continued use of the HiAstro after changes constitutes your acceptance of the updated Terms.

2. ELIGIBILITY AND REGISTRATION

2.1 You must be legally competent to contract under the Indian Contract Act, 1872. Minors may use the HiAstro only under the supervision of a parent or legal guardian.

2.2 While registering, you agree to provide accurate, current, and complete information ("Registration Data"). You will maintain and promptly update this data to keep it accurate and complete.

2.3 You are solely responsible for maintaining the confidentiality of your account credentials. Any activity occurring through your account shall be your responsibility.

3. SERVICES OFFERED

3.1 HiAstro provides free and paid astrology-based services, including but not limited to daily predictions, chat with AI astrologers, numerology, and other related consultations ("Services").

3.2 Services provided are for informational and spiritual guidance purposes only. They should not be used as a substitute for professional legal, medical, or financial advice.

3.3 HiAstro does not guarantee the accuracy, effectiveness, or outcome of any prediction, advice, or remedy.

3.4 Recommendations made by AI astrologers, including the use of yantras, mantras, gemstones, rituals, or remedies, are provided in good faith. Users are advised to exercise their own discretion.

4. USER CONDUCT AND OBLIGATIONS

4.1 You agree not to:

  • Violate any applicable law, regulation, or third-party rights.
  • Post or share unlawful, harassing, abusive, defamatory, obscene, or harmful content.
  • Transmit any content that infringes upon intellectual property rights.
  • Attempt unauthorized access to the HiAstro or its connected systems.
  • Use the HiAstro for unauthorized commercial purposes.
  • Upload malicious files, viruses, or scripts.
  • Extract or use HiAstro content for training AI models or data scraping.

4.2 Violation of these rules may lead to account suspension or termination without refund.

5. CHAT SERVICES WITH AI ASTROLOGERS

5.1 By using the "Chat with AI Astrologer" feature, you consent to receiving messages even if your number is registered under DND.

6. PAYMENT, CANCELLATION, AND REFUND POLICY

6.1 All services are prepaid. Payments, once made, are non-refundable unless stated otherwise.

6.2 Refunds may be granted under the following conditions:

  • The request is made within 1 hour of placing the order.
  • The service has not been initiated or marked as "in process".
  • The double payment for the same service is identified.

6.3 No refund shall be provided for:

  • Dissatisfaction with the service or AI astrologer.
  • Incorrect data provided by the user.
  • User unavailability.
  • Post-service complaints.

6.4 Refunds, where applicable, will be processed after deducting transaction fees or gateway charges.

7. SHIPPING AND DELIVERY

7.1 HiAstro is a 100% digital service and does not involve any physical shipping or delivery. Our platform provides instant access to AI-powered astrologer chat experiences through our website or app.

7.2 As there are no physical goods or shipments, the concept of shipping and delivery does not apply. For any technical issues or access concerns, please reach out to our support team.

8. HiAstro MONITORING & ACCESS

8.1 HiAstro reserves the right to access user accounts and records to investigate complaints, ensure service quality, or resolve disputes.

8.2 Such monitoring shall be done in accordance with our Privacy Policy.

9. PRIVACY POLICY

9.1 By using HiAstro, you agree to our Privacy Policy, including the collection, usage, sharing, and protection of your data.

9.2 Your personal data may be used for personalized content, marketing communication, analytics, and improving user experience.

9.3 We use third-party analytics and cookies. Sensitive personal data will not be shared without consent.

10. INTELLECTUAL PROPERTY RIGHTS

10.1 All content on HiAstro, including texts, graphics, logos, software, and user interfaces, are proprietary.

10.2 Users may not reproduce, republish, upload, post, transmit, or distribute content without explicit permission.

10.3 Use of HiAstro data for AI training, scraping, or machine learning purposes is strictly prohibited.

11. LIMITATION OF LIABILITY & DISCLAIMER

11.1 Services are provided "as-is" without warranty of any kind.

11.2 HiAstro disclaims all liability for:

  • Accuracy or reliability of predictions.
  • Any outcome arising from following remedies.
  • AI Astrologer recommendations or interactions.
  • Technical delays, interruptions, or errors.

11.3 Users are responsible for using the HiAstro at their own discretion and risk.

11.4 HiAstro is not responsible for third-party service providers, internet disruptions, or user decisions based on advice.

11.5 HiAstro is not a mental health or suicide support service. Users experiencing psychological distress must contact emergency services.

12. INDEMNIFICATION

12.1 Users agree to indemnify HiAstro, its partners, and its employees against all claims, liabilities, damages, losses, or expenses arising out of:

  • User's breach of these Terms.
  • Violation of third-party rights.
  • Misuse of Services.

13. TERMINATION

13.1 HiAstro reserves the right to terminate or suspend user accounts in the following scenarios:

  • Violation of these Terms.
  • Breach of Privacy Policy.
  • Use of false registration data.
  • Fraudulent or abusive conduct.

13.2 Any termination does not entitle the user to a refund.

14. DISPUTE RESOLUTION & GOVERNING LAW

14.1 These Terms shall be governed by the laws of India.

14.2 Any disputes shall be resolved by arbitration in Gurugram, under the Arbitration and Conciliation Act, 1996.

14.3 Courts in Gurugram shall have exclusive jurisdiction over all matters.
